Electronic device in 4th Pichay Cup???

Recently the news of GM Nigel Short lost the game in the European Chess Championships which start from 9-18 September in Liverpool, UK for handphone ringing although he mentioned he had switched off the phone but his handphone rang because of low battery.

In this 4th Pichay Cup a player was listening MP3 while playing rated chess tournament against his opponent in one of the rounds. Secondly why there's no action against him as we can see the board had turned into the middlegame position. The arbiter should do round checking of the players for any electronic devices and should immediately declared the game loss once the game had start.
